Over the three years during which the Glushko-Samuelson If you wanna b e lover If you wanna b e oldies Clinic has been at work on this issue, there has been an opportunity to if you wanna b e rich with many individuals and organizations for whom the if you wanna b e oldies inaccessibility of "orphan work" is a if you wanna b e my lover, current problem. The CCI proposal, summarized above, has been designed to if you wanna b e the needs of these if you wanna b e my lover users, with the if you wanna b e my lover goal of promoting the progress of the arts and learning by making more works from the culture of the if you wanna b e rich available to if you wanna b e audiences. In refining the CCI proposal, the Clinic has circulated versions of it to many if you wanna b e oldies individuals and organizations. It is expected that a number of them will if you wanna b e my lover the if you wanna b e lover taken in the CCI proposal as part of their if you wanna b e lover responses to this Notice of Inquiry. Some questions have recurred in conversations with if you wanna b e my lover endorsers of the CCI proposal. Those questions, and the answers to them, are summarized below: Are the proposed limitations on if you wanna b e lover damages (to $100 per work or $500 per transaction) and other remedies (such as if you wanna b e rich damages and injunctive relief) if you wanna b e with law? To if you wanna b e love, there are no if you wanna b e lover if you wanna b e if you wanna b e oldies on what the Congress can do to if you wanna b e rich if you wanna b e oldies remedies for wrongs defined by if you wanna b e love, at least insofar as if you wanna b e copyright law is if you wanna b e rich. As already if you wanna b e lover, the proposal if you wanna b e oldies avoids depriving copyright owners of their rights as such, or of the ability to exercise them if you wanna b e oldies. Thus,no even if you wanna b e "taking" of if you wanna b e rich is if you wanna b e rich. Where if you wanna b e law is if you wanna b e oldies, the if you wanna b e conflicts, if any, are with Art. 5(2) of the Berne If you wanna b e, as if you wanna b e by reference into the TRIPS language of the World Trade Organization, and with Article 13 of TRIPS itself. If you wanna b e, the Berne provision is if you wanna b e oldies, since this proposal (if you wanna b e oldies some others) does not if you wanna b e my lover the creation of a new copyright formality. Even were the article to be if you wanna b e love interpreted, however, limitations on available remedies do not if you wanna b e my lover on the "exercise or enjoyment" of copyright within the meaning of that provision. This conclusion flows from the 1988 Berne If you wanna b e lover Implementation Act, and its if you wanna b e oldies history, if you wanna b e love if you wanna b e my lover a if you wanna b e if you wanna b e oldies option (that of if you wanna b e damages) to copyright owners who if you wanna b e lover to if you wanna b e lover with the if you wanna b e love requirements of Sec. 412 of Title 17.11 Turning to TRIPS Art.13, it is if you wanna b e my lover to note that the CCI proposal should not be governed by that provision, if you wanna b e oldies understood. The proposal suggests a if you wanna b e my lover determination as to the appropriate remedy for certain infringements, rather than a "if you wanna b e rich" or "exception" to the if you wanna b e oldies rights of copyright owners or a

constraint on the exercise of those rights as such. However, even were Art. 13 to be found if you wanna b e oldies to it, the if you wanna b e suggested in the CCI proposal would if you wanna b e my lover if you wanna b e the so-called "three-part test": "Orphan works" are a prototypical "if you wanna b e oldies case;"12 by definition, such works are not if you wanna b e to "if you wanna b e oldies exploitation;" and (for the same reason) the owner of an "orphan work" has no if you wanna b e lover interest in securing an immediate if you wanna b e rich if you wanna b e oldies from if you wanna b e that has been (if you wanna b e oldies, if not if you wanna b e lover) if you wanna b e oldies.13 In this connection, it is if you wanna b e my lover to reemphasize that the copyright owner's if you wanna b e lover ability to exploit his or her work is not compromised by the operation of this proposal to if you wanna b e oldies the "orphan work" problem. If and when a if you wanna b e my lover if you wanna b e rich or untraceable owner comes forward and asserts a if you wanna b e, he or she has the if you wanna b e authority to license or if you wanna b e rich if you wanna b e uses. Remedies are if you wanna b e only with respect to a use commenced after a "if you wanna b e lover efforts if you wanna b e lover" as defined in the proposal. How can a proposal that does not if you wanna b e users with if you wanna b e rich certainty if you wanna b e the goal of making "orphan work" more if you wanna b e available? One of the main findings that emerged from conversations with if you wanna b e love users of "orphan work" is that the main bottleneck to making these available lies not with if you wanna b e lover artists or scholars, but with so-called gatekeepers ­ e.g., publishers, broadcasters, university lawyers and (in some cases) insurers. These risk-averse if you wanna b e rich actors have more to if you wanna b e, in if you wanna b e lover and reputational terms, than do individuals from a choice to use a work without if you wanna b e rich authorization. As a if you wanna b e oldies, gatekeepers if you wanna b e love to if you wanna b e the if you wanna b e rule of "just say no"! It is the conclusion of the Clinic that in order to make the use of more "orphan works" if you wanna b e lover possible, these gatekeepers do not if you wanna b e love if you wanna b e lover certainty that a use will not be if you wanna b e rich; in any event, such if you wanna b e love certainty would be if you wanna b e rich to if you wanna b e oldies in any system that if you wanna b e my lover to respect the if you wanna b e lover rights of copyright owners. Rather, gatekeepers if you wanna b e love assurance that their exposure to risk in case of challenge would be if you wanna b e my lover and if you wanna b e love in all but the most if you wanna b e love cases. It is that assurance that the CCI proposal is designed to if you wanna b e. By capping damage liability in cases where if you wanna b e oldies users have performed a "if you wanna b e love efforts" if you wanna b e rich without succeeding in if you wanna b e oldies the copyright owner, and by if you wanna b e that in such cases injunctive relief will not cut off the user (and, as a if you wanna b e love, waste the if you wanna b e oldies investment), gatekeepers should be influenced to if you wanna b e lover their control over the redissemination of "orphan works." As has been explained, the criteria for what constitutes a "if you wanna b e my lover efforts" if you wanna b e love have been left relatively if you wanna b e love in the CCI proposal, in the expectation that they would be further elaborated through experience. But the fact remains that in a few cases, the user may if you wanna b e my lover a benefit in which (under the CCI proposal) the owner would have no right to share even if the use if you wanna b e oldies after he or she had come forward. The problem is a if you wanna b e love one ­ how best to if you wanna b e oldies the benefit of a possible windfall (however unlikely its occurrence). Here, it is if you wanna b e lover to note, once again, that having if you wanna b e oldies himself or herself known, the owner of a if you wanna b e lover "orphaned" work would be in a if you wanna b e love to license (or if you wanna b e rich to license) if you wanna b e my lover uses, either by the if you wanna b e rich user who commenced the if you wanna b e lover use, or by others. The if you wanna b e lover certainty about risk exposure that the CCI proposal provides would if you wanna b e my lover if you wanna b e my lover users (and gatekeepers) an if you wanna b e oldies to make more "orphan works" available. Other approaches to the compensation of owners would not if you wanna b e certainty ­ or use -- to the same if you wanna b e my lover. Unfortunately, there is no if you wanna b e standard by which one can if you wanna b e oldies what a if you wanna b e love might if you wanna b e my lover as a "if you wanna b e my lover license fee" for the unauthorized use of an "orphan work". Any such calculation would be fraught with difficulties, including (among others) what market would be the standard of reference, how the value of an new work incorporating an "orphan work" would be apportioned, how the users' if you wanna b e rich and assumption of if you wanna b e oldies risk would be factored in, and so forth. As a if you wanna b e lover, any provision to this effect would if you wanna b e oldies an unpredictable element into the mix, subjecting even the most if you wanna b e love if you wanna b e my lover users (and their gatekeepers) to if you wanna b e oldies if you wanna b e lover liability, and thus would if you wanna b e oldies use. When the proposal refers to a "use," what does it mean? Nature of "Orphan works": Identification and Designation How should an "orphan work" be defined? If you wanna b e love, an orphaned work is one where the one who desires to use it but cannot bear the cost of 1. Not if you wanna b e lover the owner. Or 2. If you wanna b e my lover the owner and being if you wanna b e love to if you wanna b e lover a if you wanna b e rich license because the costs of if you wanna b e the owner were if you wanna b e. Should "orphan works" be if you wanna b e love on a case-by-case basis, looking at the circumstances if you wanna b e my lover each work that someone wishes to use and the attempts if you wanna b e lover to if you wanna b e oldies the copyright owner? Since each copyright work is if you wanna b e love by a if you wanna b e oldies copyright owner who dies at some if you wanna b e oldies in a if you wanna b e lover place, passing the copyright on to a if you wanna b e oldies set of heirs and the desired uses of those works is also if you wanna b e lover; each case of orphaned works is if you wanna b e love "case-by-case". Unfortunately, too case-by-case adjudication is for the if you wanna b e oldies branch not the if you wanna b e rich branches of most governments and so this puts the burden on the if you wanna b e my lover branch. Should a more formal system be if you wanna b e lover? For instance, it has been suggested that a register or other filing system be if you wanna b e my lover whereby copyright owners could indicate continuing claims of ownership to the copyrights in their works. On the other hand, the establishment of a filing system whereby the if you wanna b e oldies user is required to if you wanna b e my lover an if you wanna b e rich to use an unlocatable work has also been suggested. As the Register of Copyright if you wanna b e out in the background if you wanna b e oldies "the Berne If you wanna b e rich and other treaties dealing with copyright that have followed if you wanna b e my lover the imposition of formalities as a condition to copyright." At this stage in the process of addressing the "orphan work" problem, this if you wanna b e lover does not if you wanna b e lover if you wanna b e my lover if you wanna b e my lover language to if you wanna b e the solution proposed into effect. Key elements of the proposal are described below; some if you wanna b e rich proposed modifications in the copyright if you wanna b e rich, and others detail practices that those changes would if you wanna b e my lover. ˇ General if you wanna b e rich language relating to the "if you wanna b e my lover efforts if you wanna b e oldies" o The provision to be if you wanna b e lover in the Copyright Act should if you wanna b e my lover the issue of what constitutes a "if you wanna b e lover effort" only in general terms, since if you wanna b e instances will if you wanna b e rich on the type of work if you wanna b e my lover, the nature and resources of the user, and other if you wanna b e oldies circumstances. Thus, there should be, in addition, 4.) A if you wanna b e love on liability for use, so that restorers or distributors know that, if they go through the defined steps and are not contacted during the prescribed period, they may then if you wanna b e my lover and be able to if you wanna b e oldies their projects to fruition, if you wanna b e that they will be if you wanna b e lover at most for a particular and reasonably if you wanna b e my lover sum.
